ORDER TO SHOW CAUSE AND ORAL ARGUMENT NOTICE Respondent Superior Court is ordered to show cause why the petition for extraordinary writ should not be granted. Any response to the petition must be served and filed by real party in interest on or before December 30, 2016. (Cal. Rules of Court, rule 8.452(c)(2)(B).) The response must be must be served and filed electronically in compliance with the Local Rules of the Court of Appeal First Appellate District. No further briefs shall be filed without order of this court. A decision in this case will determine the merits of the petition. (See Cal. Const., art. VI, § 14; Kowis v. Howard (1992) 3 Cal.4th 888.) Before reaching a decision, the justices will have fully considered the record, the petition and the response. The parties should not use oral argument to repeat points made in the petition and response. But if oral argument is requested, the request must be filed electronically on or before December 27, 2016, using the "Request for Oral Argument" form at http://www.courts.ca.gov/9261.htm under "Electronic Filing/Submissions." If no such request is timely submitted, oral argument will be deemed waived and the court will immediately submit the cause for decision and promptly issue its decision on the merits. In addition to regular service of this order on all parties by mail, the clerk of court is directed to notify real party in interest immediately by telephone of date by which any response to the petition is due.
